The Madison County Circuit Clerk records page routes family/domestic records to the Family Court Division at 100 North Side Square, Huntsville. Use it for a divorce decree or case file only when Madison County is the court that granted the divorce. A Huntsville address alone does not prove the filing county.
| Need | Custodian | What you receive |
|---|---|---|
| Court decree / case filings | Madison County Family Court Division when the divorce was granted there. | The actual court order/file; certification available from the clerk. |
| State divorce certificate | Alabama Center for Health Statistics for Alabama divorces from 1950 forward. | Vital-record certificate, not the full decree. |
| Pre-1950 Alabama divorce | Circuit court in the county where divorce was granted. | Court-held record; state certificate coverage began in 1950. |
The ADPH divorce certificate page says anyone may request a divorce certificate if they provide enough information and the fee. The $15 search includes one certified copy or a Certificate of Failure to Find; additional copies of the same record ordered together are $6 each. Required search information includes both spouses’ full names before first marriage, divorce date, county, requester name/signature, mailing address, and daytime phone.
ADPH accepts a mail-in application to the Center for Health Statistics in Montgomery. It also says a certified Alabama divorce certificate can be requested in person at any Alabama county health department, and online or by telephone through its authorized service provider, with extra service/shipping fees. Most in-person certificates can be issued while you wait according to the current page.
The Madison County record-search/copy form asks for the specific record, case number if known, identifying information such as date of birth or alias, and whether certification is required. It lists $10 computerized, $20 paper, and $25 archived/microfilmed searches; $5 covers the first 20 pages, additional pages are $0.50, and each certification is $5. The form says allow two weeks.
The records request page says mailed requests use a money order or cashier’s check payable to the Circuit Clerk; no personal checks are accepted, while cash is accepted in person. The current Madison County filing-fee page separately lists Family Court certified copies of final orders at $20, so confirm the exact product with the clerk when ordering a certified final decree.
Use Madison County only if that court granted the divorce.
Use ADPH when a statewide Alabama divorce certificate from 1950 forward is the requested product.
Confirm whether the recipient needs a certified final order and follow the clerk’s current payment instructions.
ADPH says errors on an Alabama divorce certificate must be corrected through the county circuit court that granted the divorce. That is another reason to preserve the granting county and case number rather than relying only on a Huntsville location clue.
